Used AI in your ads? Turkey's new advertising rules may require you to disclose it

In force since August 1, 2026 · Official Gazette of Turkey, issue 33297

Short answer

Under the amendment to Turkey's advertising regulation that took effect on August 1, 2026 (Official Gazette of Turkey, July 1, 2026, issue 33297), the use of AI must be clearly disclosed not in every ad, but in two cases: when AI is used in a way that significantly affects the customer's purchasing decision, or when the ad features a digital character that cannot be distinguished from a human. Having an AI copy of a real person recommend a product is prohibited. This content does not replace legal advice.

  1. Not every use, just two cases.

    • Case 1: AI is used in a way that significantly affects the customer's purchasing decision
    • Case 2: The ad features a digital character that cannot be distinguished from a human

In these cases, the use must be clearly disclosed. The regulation does not impose a ready-made standard wording. (Official Gazette 33297 · Article 18/8)

  2. No fake endorsements from real people.

An AI-generated copy of a real person cannot be shown as if they have used, tried or recommended the product. In practice: an “I use it too” video generated with a celebrity's or a customer's face falls under this article. (Article 27/12)

  3. “Why am I seeing this ad?”

In targeted advertising, consumers must be given easily accessible information on the criteria by which the ad is shown to them and how they can change those criteria. Targeted ads cannot be directed at people who are known, or should reasonably be known, to be children. (Article 25/A)

  4. Influencer posts must carry “Reklam” (Ad) or “Tanıtım” (Promotion).

    • Next to it, the brand's name or “provided by @brand”
    • Visible without scrolling, before any other tags
    • Repeated in every post of a series
    • In audio content, “contains advertising/promotion” at the start

    (Article 23/A)

  5. Don't inflate the old price; explain “eco-friendly”.

Discounts: for products, the price before the discount is taken to be the lowest price in the 10 days before the discount began.

Environmental claims: general statements cannot be used without explanation; the certificate must come from an authorized body, and it must be stated which part of the product it covers. (Articles 14, 17)

  6. Fines · 2026

In 2026, the administrative fine for online advertising violations ranges from about $21,653 (₺1,083,706) to about $216,530 (₺10,837,065) (converted at the TCMB rate of November 5, 2026: $1 = ₺50.05).
